Usage data
Even without the installation of cookies, the administrator of the website may access the following data showing how the website is used (hereinafter: "other usage data"):
- ID assigned to the device of the visitor;
- ID of the telecommunication network terminal;
- ICT system (type of device, operating system, web browser) used by the Internet user;
- information about the start, end and extent of each use of the website.
The data are not associated with individual website visitors. To ensure the highest quality of service, from time to time we analyse log files to see, for example, which pages are visited most frequently or what web browsers are used, and to check the page structure for errors.
Personal data protection
Information accessed by us is in principle general (statistical) in nature. Nevertheless, the concept of 'personal data' in the GDPR (Regulation (EU) 2016/679) also covers information on identifiable persons. As provided for by the GDPR, to determine whether a natural person is identifiable, account should be taken of all the means reasonably likely to be used (such as singling out), either by the controller or by another person, to identify the natural person directly or indirectly. To ascertain whether means are reasonably likely to be used to identify the natural person, account should be taken of all objective factors, such as the costs of and the amount of time required for identification, taking into consideration the available technology at the time of the processing and technological developments.
Therefore, information obtained through cookies and usage data may constitute personal data within the meaning of GDPR. If the above information is classified as 'personal data', then the controller of your personal data is Colliers Poland Sp. z o.o. with its registered office in Warsaw, Pl. Piłsudskiego 3, 00-078 Warsaw. Even if we are unsure whether a particular category of information is personal data, we introduce mechanisms to protect such information as if it were personal data. You can contact the controller at the following address for all personal data protection issues: DaneOsoboweCP@colliers.com.
The processing of the above categories of data to the extent necessary for the correct display of the website ("necessary" cookies) is based on the so-called legitimate interest pursued by the website administrator (Article 6(1)(f) of the GDPR). For that purpose, the following may take place:
- occasional analysis of log files to determine which browsers visitors use; which bookmarks, pages or subpages are most or least frequently visited or viewed; and whether the page structure is error-free;
- prevention of unauthorized access to the website or dissemination of malicious codes, interruption of 'denial of service' attacks and prevention of damage to computer and electronic communications systems.
In these cases, you have the right to object (where processing takes place on the basis of Article 6(1)(f) of the GDPR).
Whereas if you give your consent by enabling "optional" cookies in your browser (analytical cookies, for instance provided by Google Analytics), then any information collected in that way will be used in order to find out about the preferences of users of our website so that such findings may be used to improve the quality of website display. In this case, the basis for data processing is Article 173(2) of the Telecommunications Act (Journal of Laws of 2004, No 171/1800), in conjunction with Article 6(1)(a) of the GDPR. As stated in Article 174 of the Telecommunications Act, the provisions on the protection of personal data apply to obtaining the consent of the subscriber or end-user.
You may withdraw your consent and delete cookies from the device at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
The providers of analytical tools to whom the data may be entrusted are indicated in the table above. The table also indicates whether the data may be transferred outside the European Economic Area and on what terms and conditions.
You have the right to access the data, including to obtain a copy of the data, the right to data portability, the right to rectify and erase the data, and the right to restrict their processing. Due to the limited identifiability of the data (the data are to a large extent statistical in nature), in accordance with Article 11(2) of the GDPR, the exercise of the indicated rights may depend on the provision of additional information to identify the data and verify the identity of the requester.
You have the right to lodge a complaint with the supervisory authority (President of the Personal Data Protection Office (UODO)).
Personal data will be deleted or anonymized not later than upon the expiry of the statute of limitation for potential claims related to the use of the website (not later than two years after the date of fixation), or earlier if you raise an effective objection. Data are given freely but their provision is necessary for the above purposes.
You can read more about how we safeguard your privacy by going to polityka prywatności (privacy policy).
